Treatment Requests To Notarize Out-Of-State Documents

US State Map

Notaries know they are simply authorized to notarize within the jurisdiction divers by your land, which in most cases is your land. But what do you practice if a signer needs to have an out-of-state document notarized? Are yous authorized to practise then, and, if then, how?

The Easy Answer: Yes, You May Notarize Out-Of-State Documents

You are allowed to notarize documents that are sent and /or recorded across country borders — provided, of course, that yous are notarizing the document within the boundaries of your jurisdiction.

It doesn't matter where the documents will be recorded as long every bit you are post-obit the Notary laws for your state. This includes documents for out-of-state real estate transactions, such as purchases or mortgage refinances.

Annotation, all the same, that Notaries in Kentucky with a Special Commission may only notarize documents that will be recorded in Kentucky.

Check — And Correct — The 'Venue'

Be sure the "venue" portion of the notarial certificate reflects the country and county where the notarization really takes place; if that portion of the certificate is pre-populated with some other venue, cross through information technology and enter the right data.

Know — And Follow — All Your Country's Notary Laws

Even when notarizing an out-of-state document, which may have certificates specific to the state where it is being filed, you are even so responsible for knowing and post-obit your own jurisdiction's laws.

For example, in California, as of Jan 1, 2013, any document that affects real property requires the Notary to obtain the thumbprint of all signers in your Notary journal. You volition need to record the signers' right thumbprint for every certificate you are notarizing within the refinance package, since the mortgage, deed of trust or any affidavits in the package affect real property. This law applies regardless of where the belongings is located.

Remember: When dealing with out-of-state documents, the Notary laws of your jurisdiction ever supercede those of the state in which the document will be recorded.
